Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Fovisto platform at https://fovisto.com and all associated tools, including F Health, F Inventory, F Invoice, F Logistics, F HR, F QA, F Data, and any tools added in future (together, "Services"). By creating a Fovisto account or using any Service, you accept these Terms in full.

If you are accessing a Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

You are responsible for:

• Keeping your login credentials confidential and not sharing them with others.
• All activity that occurs under your account, whether or not authorised by you.
• Providing accurate registration information and keeping it current.
• Notifying us immediately at info@fovisto.com if you suspect unauthorised access to your account.

One Fovisto account gives access to all tools included in your plan. You may not create multiple accounts to circumvent plan limits.

You agree not to use the Services to:

• Attempt unauthorised access to the platform or to other users' accounts or data.
• Disrupt, degrade, or overload the platform through automated scraping, bots, or similar means without written permission.
• Upload, share, or distribute unlawful, infringing, harmful, or misleading content.
• Reverse-engineer or attempt to extract source code from the Services.
• Resell or sublicense access to the Services without our written consent.
• Violate any applicable local, national, or international law or regulation.

We may suspend or terminate accounts that breach these Terms, with or without prior notice depending on severity.

Some Fovisto tools offer a free tier. Paid plans are available for business and clinic use. By subscribing you agree that:

• Fees, billing cycles, and applicable taxes are shown at checkout before payment.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel or downgrade your plan at any time from your account settings.
• Refunds are assessed on a case-by-case basis at our discretion.
• If a payment fails, access to paid features may be suspended until the payment is resolved.

The Fovisto platform — its software, design, trademarks, and editorial content — is owned by Fovisto and protected by applicable intellectual property law.

Content you create within the Services (health logs, invoices, inventory records, quality reports, etc.) remains yours. You grant Fovisto a limited, non-exclusive licence to store and process your content solely to provide and operate the Services. We make no claim of ownership over your data.

We aim for high availability but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, modify features, or discontinue parts of the Services with reasonable notice where feasible. We may also update these Terms — material changes will be communicated by email or in-platform notice. Continued use after the effective date constitutes acceptance of the revised Terms.

To the maximum extent permitted by applicable law:

• Fovisto is not liable for indirect, incidental, special, or consequential damages arising from use of the Services.
• Our total liability for any claim is limited to the fees you paid us in the 12 months preceding the claim.
• Nothing in these Terms limits liability that cannot lawfully be excluded — including liability for fraud, death, or personal injury caused by our negligence.

These Terms are governed by the laws of the Federal Republic of Germany. Disputes arising under these Terms shall be subject to the exclusive jurisdiction of the German courts, unless mandatory consumer protection law in your country of residence provides otherwise.

Medical advice disclaimer. F Health is a personal health-tracking and information tool. It does not provide medical advice, clinical diagnosis, or treatment recommendations. All outputs — including AI-powered insights, trend analysis, and protocol suggestions — are for informational and educational purposes only. Always consult a qualified healthcare professional before making any medical decision. See our full health disclaimer.

Health data. You voluntarily log sensitive health data (vitals, symptoms, lab results, medications, etc.) into F Health. You are responsible for the accuracy of the data you enter. By using F Health you grant explicit consent for Fovisto to process this data to operate the service. You may withdraw this consent at any time by deleting your account.

Clinic and professional accounts. If you operate a clinic or professional account, you are responsible for ensuring you hold the appropriate legal basis for processing patient data via F Health (e.g. patient consent, §630f BGB in Germany, GDPR Art. 9) and for complying with all applicable medical data protection requirements. Fovisto acts as a data processor on your behalf for patient records.

AI-generated insights. AI health insights, protocol suggestions, and scores are experimental and may contain errors. They must not be used as a substitute for professional medical advice or clinical judgement.

Business data accuracy. You are solely responsible for the accuracy of inventory records you maintain in F Inventory, including product information, stock levels, SKUs, and supplier data.

Supplier and partner data. If you enter third-party supplier or partner information (names, contact details, addresses), you are responsible for ensuring you have a lawful basis for processing that data under applicable data protection law.

AI demand forecasts. Stock forecasts and automated reorder suggestions are estimates based on your historical data. They do not constitute procurement or financial advice. All purchasing decisions remain your responsibility.

Not a carrier. Fovisto is not a courier or freight carrier. F Logistics is a shipment management and tracking tool only. Fovisto is not party to any shipping or transport contract between you and a courier or logistics provider.

Recipient personal data. You are responsible for ensuring you have a lawful basis for storing sender and recipient names and addresses within F Logistics in accordance with applicable data protection law.

Carrier liability. Fovisto is not liable for delays, losses, or damage to shipments. Claims for lost or damaged goods must be pursued directly with the relevant carrier.

Invoice accuracy. You are responsible for the accuracy of all invoice content — including line items, pricing, VAT numbers, and applicable taxes. F Invoice provides tools to help you create and manage invoices; it does not independently validate tax rates, VAT numbers, or legal compliance.

Tax compliance. Fovisto does not provide tax, accounting, or legal advice. You are responsible for ensuring that invoices you issue comply with applicable law and tax regulations in your jurisdiction. Consult a qualified accountant or tax adviser for specific guidance.

Client billing data. You are responsible for processing client names, addresses, and billing information in F Invoice in compliance with GDPR and applicable data protection law, including maintaining an appropriate legal basis for storing client personal information.

Uploaded files. By uploading files or datasets to F Data, you confirm that you hold the rights to process and share the data contained in those files and that doing so does not violate any applicable law or third-party rights.

Automatic deletion. Uploaded files are processed and — unless you explicitly save them — deleted from our servers within 24 hours of export. Saved datasets are retained until you delete them or close your account.

Output accuracy. AI-generated reconciliation and analysis results depend on the quality and format of your input data. Always validate outputs before making business decisions based on them. Fovisto is not liable for losses arising from decisions made on the basis of F Data outputs.

Confidentiality. Uploaded business data is treated as confidential. We will not access your files except to provide the service or as required by law.

Job listings. You are responsible for ensuring that all job postings created in F HR comply with applicable employment law in your jurisdiction, including equal-opportunity and non-discrimination requirements.

Candidate data. If F HR is used to collect or manage candidate applications, you act as the data controller for candidate personal data (names, CVs, contact details, assessment results) and must handle it in compliance with GDPR and applicable employment law. Fovisto acts as a data processor in this context.

Employee records. HR records stored in F HR — including employment details, performance notes, and assessments — are strictly confidential. Access is limited to authorised users within your organisation as configured by your administrator.

Quality records. F QA supports quality management workflows including inspection checklists, defect tracking, and audit trails. Records generated in F QA are for your internal use. Fovisto does not certify or validate quality processes, and outputs do not constitute regulatory certification or compliance confirmation.

Regulatory responsibility. You are solely responsible for maintaining the accuracy and completeness of quality records and for complying with any regulatory or certification requirements applicable to your industry (e.g. ISO standards, GMP, sector-specific regulations). Fovisto is not liable for regulatory consequences arising from incomplete or inaccurate records.

Record retention. Quality and audit records are retained for the duration of your account. We recommend you export and archive records in accordance with any regulatory retention requirements that apply to your industry before closing your account.
